The Constitutional Court of Romania (CCR) is in an unconstitutional situation. I hereby ask the President of CCR, Valer Dorneanu, to explain publicly whether he has informed the Presidency that the term of Judge Lăzăroiu had expired. Dorneanu is in the public service and should serve the Constitution, not a party.
President Iohannis must immediately appoint a new judge for the CCR in order to restore constitutional order, and tell Romanians whether and when he was informed by Dorneanu.
The term of Judge Petre Lăzăroiu expired according to the CCR decision issued on 20th March, published on 4th May 2018, because its duration exceeded the maximum of 9 years, as provisioned by the Constitution. President Iohannis must now make a nomination for a replacement, as the judge was appointed by the Presidency.
Article 68 para 1 of Law 47/1992 on the organization and functioning of the CCR states that the President of the Court is compelled to inform the institutions about the end of the terms for the judges they have appointed. Has Valer Dorneanu respected the Law 47/1992 and the March 20th decision of the Court?
Since the publication of the decision, on 4th May 2018, any unconstitutional provisions „are lawfully suspended”. The CCR is therefore functioning against the Constitution, as a judge issuing decisions despite his mandate no longer being valid, all the CCR decisions of the past month are unconstitutional. The first responsible for the Court’s decisions in violation of the Constitution is President Dorneanu. Dorneanu must immediately resign!
Moreover, don’t you think that whoever applies them violates the Constitution?
