The mandate of Ms. Kovesi, the DNA Chief Prosecutor, did not had to end under fatal influence of politicians led by Dragnea & comp. who only want to get rid of their files and convictions.
An unconstitutional decision of the Constitutional Court of Romania (CCR) fulfills the wish of the PSD & ALDE offenders, and President Iohannis gave the politicians with criminal problems another chance today.
In a state governed by the rule of law, the Constitution is respected! The Constitution does not request to respect the decisions of an institution that works unconstitutional, even if it is the CCR itself. The name „Constitutional Court of Romania” does not make it constitutional, but its decisions, if they are in line with the Constitution. There is a simple question: Do we respect the Constitution or the decision of the Court, which is functioning and deciding unconstitutionally since 20 March 2018, with 8 judges instead of 9, even if Mr. Lăzăroiu stands there and votes although he has exceeded the 9-year mandate provided by the Constitution?
CCR, which is formed of only 8 judges with a constitutional mandate, has forced the president to revoke Laura Codruta Kovesi. No decision of this Court is constitutional or applicable until Mr. Lăzăroiu, who has exceeded the 9-year mandate as provisioned by the Constitution in art. 142, is not replaced by another judge.
Today, the president applied an unconstitutional decision. Why? Maybe he can tell us directly, not through his spokesperson, but by organizing a press conference with questions and answers, and not releasing press statements only.
The announcement of the Presidency regarding the revocation of the DNA Chief Prosecutor has a political burden that can only have side effects on the independence of the justice. The announcement of the Presidency also shows the weakness of President Iohannis, who has not even announced the revocation decision directly, but through a spokesperson.
While Dragnea and Tariceanu are thinking gradually their plan to deprive the President of its powers, Mr. Iohannis has not even tried to defend his duties.
It is vital for Romania that the anti-corruption fight continues. Judges and prosecutors across the country shall continue impartial investigations and prosecution against corrupt politicians.
