The decision of the Constitutional Court of Romania (CCR):
- The minister of justice, a politician in the ruling party or coalition, will decide on the career of chief prosecutors of National Anticorruption Directorate, General Prosecutor’s Office and Directorate for Investigating Organized Crime and Terrorism, subordinating them politically. The president is removed from the game, becoming a „stamp”. Although he was voted by more than 6 million people, the president was subordinated to the decision of a politician named politically by a coalition that received about. 3.6 million votes. The Superior Council of Magistracy (SCM) is removed from the revocation procedure of chief prosecutors. Besides, the advising opinion of the SCM was not taken into consideration by the Minister of Justice. The PSD-ALDE toxic coalition is rapidly following the road of politically subordinating the prosecutors, destroying the justice and stopping the anti-corruption fight, in order to escape investigations, convictions and confiscations.
- There is an obvious lack of balance between the powers of the state: prerogatives have been taken from the president and moved to the Government through the Justice Minister.
The Constitutional Court should defend the Constitution, the balance of powers in the state, and democracy. We see how justice comes into the hands of a single politician, the Justice Minister, who, since taking office, is the lawyer of politicians with criminal files. The CCR decision joins other lately controversial decisions, and the public opinion tends to observe this.
